Property Rights and Eminent Domain
Pacifica attorneys prosecute and defend claims related to public and private projects, including inverse condemnation, takings, trespass, timber trespass, and complex constitutional claims. We represent clients in property rights claims, including disputes concerning ownership rights, boundaries, easements, and access matters.
We have particular expertise representing public entities and agencies in connection with facility development as well as transportation and utility infrastructure construction. We regularly assist clients with the acquisition of property needed for complex projects, including through the exercise of eminent domain.
Land Use and Environmental Matters
Pacifica attorneys regularly advise and represent clients in land use disputes, including permitting disputes and challenges to environmental review.
We have successfully represented both public and private entities in land use litigation under the Land Use Petition Act and the Growth Management Act, both at the administrative and court levels. We also advise and advocate for clients in seeking Comprehensive Plan and zoning code amendments needed to accommodate public projects, and assist in negotiating project-specific development agreements.
Pacifica attorneys also have negotiated and litigated a variety of environmental claims, including environmental tort claims and National Environmental Policy Act (NEPA) and State Environmental Policy Act (SEPA) appeals.
